This ordinance amends Santa Cruz Municipal Code Section 10.85.040 to incorporate an exemption for non-residential projects at or under 1,000 gross square feet, establish an option for a payment plan provided the owner of the property enters into a recordable agreement with the City prior to building permit issuance, and combining the Citywide and Beach/SOLA areas.

Summary

The purpose of the ordinance is to create incentives to help preserve, maintain and rehabilitate existing historic properties. Another purpose is to ensure that new construction and alterations are allowed in a manner which retains the integrity of the City’s historic landmarks, buildings, sites, objects, and contributing buildings within districts. he Zoning and Subdivision Ordinance Amendments will provide incentives for historic properties which are listed on the City Historic Building Survey and for contributing buildings within historic districts. Incentives include but are not limited to: provisions for larger accessory dwelling units, a 15-percent parking bonus, waiver of the covered parking, front yard parking and tandem parking requirements, limited allowances for multi-family residential uses in R-1 (single-family residential) zones, offices in residential zones near commercially-zoned properties, expansion of single-family homes in RL and RM zone districts, expansion of non-conforming structures and uses, and condominium conversions with an exemption form the vacancy rate restriction. An additional amendment adds regulations to require a discretionary Demolition Permit for non-residential buildings.

Summary

This ordinance adds a new Chapter (6.07) to the Santa Cruz Municipal Code regarding the local licensing of tobacco retailers in the City of Santa Cruz, with the intent of eliminating the sale of tobacco and tobacco-related products to minors. Tobacco retailers within the Santa Cruz City limits will be required to obtain a local tobacco retail license and renew that license annually in order to sale tobacco and tobacco related-products. An annual license fee is required, which will help offset the costs of the tobacco retail license program education and enforcement efforts.

Summary

Section 9.36.020 of the City’s noise ordinance prohibits a person from making noises which are 1) unreasonably disturbing or physically annoying to people of ordinary sensitiveness and 2) which are not necessary in connection with an activity which is lawfully required. This ordinance would amend Section 9.36.020 by deleting the second provision thereby creating a simple prohibition against all unreasonably disturbing or physically annoying noises. Section 9.36.025 provides that the noise ordinance will not apply to activities undertaken by the City, other governmental agencies or City contractors for public health and safety purposes. This ordinance would amend Section 9.36.025 by adding an exception for events that are conducted with a permit issued by the City.

This ordinance repeals outdated Chapter 6.50 adopts a new Chapter 6.50 which removes conflicts with the County of Santa Cruz Hazardous Materials Ordinance and recognizes that the County of Santa Cruz Environmental Health Services Agency is the state designated Unified Program Agency (CUPA) for the City of Santa Cruz.

This ordinance adds Chapter 6.52 establishing Minimum Standards for the Recycling of Electronic Waste to require electronic waste (e-waste) collected within the City of Santa Cruz to be delivered to a certified recycler and e-waste recyclers operating within the City to be certified.

Summary

No vendor or event promoter in the City of Santa Cruz may sell, rent or otherwise provide any polystyrene/plastic foam product which is not wholly encapsulated or encased within a more durable material. This specifically includes, but is not limited to, cups, plates, bowls, clamshells and other products intended primarily for food service use, as well as coolers, containers, ice chests, shipping boxes, pool or beach toys, packing peanuts, or other packaging materials.

Summary

This ordinance seeks the reduction of single-use bags, commonly referred to as “carry out” bags. It affects all retail businesses that give their customers carry out bags. The ordinance bans the distribution of plastic carry out bags and places a 10-cent charge on all paper carry out bags given to customers which is kept by the retailer to offset the costs of implementing the program. All paper bags must contain 40% post-consumer recycled content. Restaurants are exempt, as well as bags used to contain loose items prior to checkout (such as produce bags) and bags to protect items such as meat or wet items.

Summary

This ordinance amends Section 10.60.010 to set the local limit for eleven (11) street segments to the prima facie speed, based upon an engineering and traffic survey, of 30 miles per hour from the current 25 miles per hour. The eleven street segments consist of parts, but not the whole of: Bay, Market and High Streets; Delaware Avenue; Isbel and Western Drive; and, Morrissey and Natural Bridges Boulevards.

Zoning Amendment to Title 24 (Zoning Ordinance) of the Santa Cruz Municipal Code and the Local Coastal Implementation Plan, to include: removal of the requirements of number of stories in the Industrial (IG) and Industrial Performance (IGPER 2) Districts; amending the requirement for roof top equipment screening; and allowing outdoor extension areas for certain commercial and industrial districts outside of the Downtown Recovery Area Plan.

This ordinance establishes a local business preference for the City of Santa Cruz’ competitive purchasing process for goods, supplies, equipment, materials, services, and professional services. The ordinance establishes two tiers of preferences: a two (2) percent “local presence” preference and a separate, overlying four (4) percent “locally owned business” preference, and sets forth the qualifications for the “local presence” and a “locally owned” business.

Summary

This ordinance establishes a second tier retirement benefit formula for local miscellaneous members entering membership for the first time in a miscellaneous classification after the effective date of this amendment to the contract. It decreases the benefit from the current 2% @ 55 formula to 2% @ 60 and changes the final compensation calculation from “single highest year” to “three-year average.”

Summary

The “Desalination Plant-Voter Approval” ordinance requires the City Council to submit the question of whether or not the City will construct a desalination plant to City voters prior to the time the City Council takes any legislative action, the effect of which would be to authorize or permit construction of a desalination plan in the City. The vote would take place at either a regularly scheduled statewide or general municipal election. The ordinance requires environmental review of the desalination project to be completed prior to the vote and does not prohibit the City from taking other action, short of construction, with regard to desalination plant planning such as necessary studies and the preparation of construction plans.

Summary
This ordinance implements programs required by the Senate Bill 2 (2007) by allowing emergency shelters in the Public Facilities Zone District as a use allowed by right and establishes development and operational standards for such uses. The ordinance also makes changes to the Industrial Zone District to allow emergency shelters with a Special Use Permit and establishes “supportive housing” and “transitional housing” types as residential uses.
